تقدم الخدمات والمنتجات، إلى الحد الذي يسمح به القانون، على أساس "كما هي" و**"حسب التوفر"**.

لا تهدف هذه الشروط إلى استبعاد أي حقوق قانونية للمستهلك لا يجوز استبعادها بموجب القانون.

17. تحديد المسؤولية

إلى أقصى حد يسمح به القانون، لا تكون PearlNest.store أو مالكوها أو موظفوها أو شركاؤها أو وكلاؤها مسؤولين عن الخسائر غير المباشرة أو العرضية أو الخاصة أو التبعية الناتجة عن استخدام خدماتنا أو منتجاتنا، باستثناء الحالات التي لا يسمح القانون باستبعاد المسؤولية فيها.

لا تستبعد هذه الشروط أي مسؤولية لا يمكن استبعادها قانونيًا.

18. التعويض

إلى الحد الذي يسمح به القانون، توافق على تعويض وحماية PearlNest.store ومالكيها وموظفيها وشركائها ووكلائها ومقدمي خدماتها من المطالبات أو الخسائر أو الأضرار الناتجة عن:

  1. مخالفتك لهذه الشروط.

  2. مخالفتك للقوانين المعمول بها.

  3. انتهاك حقوق أي طرف آخر.

  4. إساءة استخدام خدماتنا.

  5. المحتوى الذي تقدمه والذي يخالف هذه الشروط أو القانون.

19. قابلية الفصل

إذا تم اعتبار أي بند من هذه الشروط غير قانوني أو غير صالح أو غير قابل للتنفيذ، فسيتم تطبيقه إلى أقصى حد يسمح به القانون.

ولا يؤثر ذلك على صلاحية باقي البنود.

20. التنازل والاتفاق الكامل

عدم قيامنا بتطبيق أي بند من هذه الشروط فورًا لا يعني أننا تنازلنا عن حقنا في تطبيقه لاحقًا.

تشكل هذه الشروط، إلى جانب سياسة الخصوصية وسياسة الإرجاع والاسترداد والسياسات الأخرى المنشورة على الموقع، الاتفاق الذي يحكم استخدامك لخدماتنا.

21. التنازل عن الحقوق ونقلها

لا يجوز لك نقل أو التنازل عن حقوقك أو التزاماتك بموجب هذه الشروط دون موافقتنا الكتابية المسبقة عندما تكون هذه الموافقة مطلوبة.

ويجوز لنا نقل حقوقنا والتزاماتنا في حالات مثل إعادة الهيكلة أو الاندماج أو الاستحواذ أو أي معاملة تجارية مشروعة، وفقًا للقانون.

22. القانون والاختصاص القضائي

تخضع هذه الشروط وتفسر وفقًا للقوانين المعمول بها في دولة الإمارات العربية المتحدة، مع مراعاة حقوق المستهلك الإلزامية وأي متطلبات قانونية تنطبق عليك.

تخضع النزاعات المتعلقة بهذه الشروط أو باستخدام خدماتنا للاختصاص القضائي للمحاكم المختصة في موقع أعمال PearlNest.store، ما لم ينص القانون على خلاف ذلك.

مكان النشاط التجاري: دبي، الإمارات العربية المتحدة.

23. العناوين

تم استخدام عناوين الأقسام لتسهيل القراءة والتنظيم فقط، ولا تؤثر على تفسير هذه الشروط.

24. تعديل الشروط

يجوز لنا تحديث أو تعديل هذه الشروط من وقت لآخر لمواكبة التغييرات في أعمالنا أو خدماتنا أو المتطلبات القانونية.

سيتم نشر أحدث نسخة من الشروط على موقعنا مع تحديث تاريخ آخر تحديث.

عند إجراء تغييرات جوهرية، سنقدم إشعارًا مناسبًا عندما يكون ذلك مطلوبًا بموجب القانون.

استمرارك في استخدام خدماتنا بعد نشر التحديثات يعني موافقتك على الشروط المحدثة، إلى الحد الذي يسمح به القانون.
